the case was heard by the Karnataka High Court on August 22, 2024, which granted an interim relief and also put a stay on the case against the man. While hearing the case, Justice M Nagaprasanna of the Karnataka HC called it “absolutely trivial” and “misuse and abuse” of laws.
“Allowing any investigation against the husband would become an abuse of the process of law and putting a premium on the allegations of the wife that she was not given to eat french fries at the relevant point of time. Therefore, there shall be an interim order. of stay on all investigation qua the husband,” Justice M Nagaprasanna said, reported Bar and Bench.
Apart from putting a stay on the case, the court also permitted the man to travel to the US for work after he gave an affidavit to the court that he would cooperate with the authorities.
What went wrong between the man and his wife?
As per reports, the woman had filed a case against her husband and his parents for not allowing her to eat foods like french fries, rice, and meat after childbirth. The HC had earlier put a stay on the probe against the man’s parents.
On his part, the husband argued that he was made to do household work by his wife during their six years of married life when they were living in the US, before their child was born. She also alleged that she spent her time either on the phone or on “watching Pakistani dramas.”
Listening to the man and the woman’s allegations against each other, Justice M Nagaprasanna stated that this was an abuse of the law. He also said that Circular Look against the man, because of which he wasn’t able to return to the US for work, was also being “used as a weapon” against him in this case.
